Provider
The party offering hotel stays, packages, and additional services via the Platform.
Offer/Offers
The offer made by a Provider to the User via the Platform regarding hotel stays, packages, and additional services. All conditions applicable to the Offer, such as Cancellation Conditions, are included in the Offer.
Cancellation Tool
The website where the User can cancel a Booking (as far as permitted under the Cancellation Conditions): annuleren.fletcherpartnerhotels.nl.
Cancellation Conditions
The cancellation conditions displayed on the hotel page.
Package Price
The cost of the Booking as shown in the Reservation Overview, including any fees and applicable taxes. Costs not included are not part of the Package Price.
Booking
The agreement between the User and a Provider regarding an Offer made by the Provider via the Platform.
Booking Confirmation
The confirmation to the User of the Booking.
Fletcher

Any visitor using the Platform.
User Terms
These general terms and conditions of use for Users of the Platform by Fletcher.
Non-Included Costs
Costs to be paid directly by the User to the Provider, such as local fees (e.g., city and tourist taxes) and costs for separately booked or used services (e.g., breakfast, taxi costs, and parking fees) that are not listed in the Reservation Overview and are therefore not included in the Booking.
Platform
The online booking platform Fletcher Partner Hotels.
Reservation Overview
The complete overview of the intended Booking, which the User sees at the end of the booking process, before finalizing the Booking. The Reservation Overview includes at least the User's details, the Provider's details, the intended booking dates, and the Package Price.
1.1
Fletcher acts as an intermediary between the User and the Provider, providing the User with the opportunity to make bookings for hotel stays, packages, and additional services quickly and easily online through the Platform.
1.2
Fletcher is responsible for the operation of the Platform.
1.3
Fletcher is not a party to a Booking and is not responsible for the execution of a Booking.
1.4
All information related to an Offer has been received by Fletcher from the Provider. The Provider is responsible for the content of the Offer, including its accuracy and completeness. Fletcher is not responsible for the Offer and is not liable for inaccuracies or missing information in the Offer, unless there is proven negligence on the part of Fletcher.
2.1
By making a Booking, the User accepts the User Terms. The User Terms apply to the User's use of the Platform and the relationship between the User and Fletcher.
2.2
The User is not required to pay a fee to Fletcher for using the Platform. The User is not required to pay a fee to Fletcher for using the Platform.
2.3
The User is responsible for everything they do on the Platform and the accuracy of all information provided there. Unless otherwise specified, the User must be at least 18 years old to use the Platform.
2.4
The User must:

The Platform displays the offers of Providers.
3.2
When the User accepts an Offer from a Provider via the Platform, a Booking is formed.
3.3
When the User makes a Booking, they accept the terms of the Offer as displayed during the booking process. The booking conditions (including any Cancellation Conditions) are listed on the hotel page under "Hotel Conditions."
3.4
An Offer from a Provider on the Platform is revocable. This means the Provider can revoke the Offer, even after the User has made the Booking. The Provider can do this up to 5 days after the Booking Confirmation has been sent. If such revocation occurs, the User is entitled to a refund of the Package Price paid to the Provider.
3.5
The Provider determines which room of the booked room type will be assigned to the User at check-in. The Platform has no influence over this.
4.1
When the User makes a Booking, they agree to the (Platform-listed) Package Price.
4.2
If an incorrect price or incorrect information is listed, for example, if a hotel room or package is offered at a rate that is substantially and demonstrably lower than usual, the Provider has the right to cancel the Booking once the error is discovered. The User will be informed as soon as possible, and any Package Price already paid will be refunded as soon as possible. If the User wishes to maintain the Booking, the corrected rate will apply.
4.3
The Package Price is also based on the number of guests and the age of the guests on the intended dates of stay. The User is responsible for the accuracy of the data provided during the booking process. Incorrect or incomplete data may lead to additional costs and other consequences.
5.1
The payment of the Package Price by the User is made via one of the payment methods offered by the Platform and chosen by the User during the Booking process. Fletcher collects the Package Price on behalf of the Provider. Therefore, the User does not have to pay the Package Price directly to the Provider.
5.2
Non-included costs must be paid directly by the User to the Provider. Fletcher does not play an intermediary role in this regard.
6.1
The User can only cancel a Booking if a right of cancellation has been agreed upon. This is only the case if the right of cancellation is part of the Offer that led to the Booking. The (possible) Cancellation Conditions are listed in the Offer. Cancellation may be subject to fees.
6.2
The cancellation of a Booking by the User can only be done via the Cancellation Website. For questions regarding cancellations, the User can contact [email protected].
6.3
If the User is entitled to a full or partial refund of the Package Price after cancellation, the User has a claim against the Provider. Fletcher will arrange the refund to the User on behalf of the Provider as part of its collection function.
6.4
The refund will be made to the payment method used during the Booking process. This method cannot be changed.
6.5
If the Booking (in whole or in part) cannot take place due to the insolvency or suspension of payments by the Provider, the User can submit their claim to the Provider's insolvency administrator. As Fletcher is not a party to the Booking, the User cannot claim the Package Price from Fletcher in any way.
7.1
There is no right of withdrawal concerning the Booking (as mentioned in Article 6:230o of the Dutch Civil Code), because it is an agreement as referred to in Article 6:230p of the Dutch Civil Code (exclusion for accommodation and transportation services).
8.1
Complaints about Fletcher and/or the Platform can be sent to [email protected].
9.1
Fletcher is not responsible and not liable for the execution or complaints regarding the Booking.
9.2
Fletcher is only liable for direct damage caused by proven intent or gross negligence by Fletcher.
9.3
Any liability of Fletcher is limited to the amount paid out by Fletcher’s insurer in the respective case.
10.1
Fletcher is not liable if it fails to meet any obligation under the User Agreement and/or User Terms due to force majeure. Force majeure includes, but is not limited to, the following circumstances: natural disasters such as floods, earthquakes, storms, and fires, war, terrorism, riots, or other forms of civil unrest, government measures or restrictions such as sanctions, embargos, quarantine regulations, or travel bans, strikes, company occupations, or work interruptions by third parties on whom Fletcher depends, disruptions in energy supplies, telecommunications, or internet connections, system failures of third parties, DDoS attacks, hacks, and other forms of cyber-attacks or (digital) sabotage, pandemics, epidemics, and other large-scale health crises.
10.2
In the event of force majeure, Fletcher is entitled to suspend the performance of the User Agreement without any liability for damages. If the force majeure lasts longer than 30 days, Fletcher is entitled to terminate the User Agreement without any liability for damages.

Dutch law applies to these User Terms.
